If he knew the brakes were bad, he should have refused to have taken the bus. If he indeed heard a loud screech, then he knew something was wrong. It is the driver's responsibility to approve the condition of the bus, much like a pilot's responsibility to accept an aircraft for flight. It was a tragic accident, and I know the driver did not set out to kill a passenger. It sounds like he has a reputation for crashes, however, since his nickname is crash. My heart aches for both the driver and the family of the dead passenger.
