That is not at all the case. It is simply a fact that the consent is part of the cruise contract. If people don't read the contract then it is their fault and not mine. It's like when you break a law but claim you didn't know about the law. You won't find much sympathy from the police.

And I feel safe in saying that 99.9% of people wouldn't mind, even if they did read and understand the contract.

With all due respect...If you are in public, you photo may be taken and used. It is done all the time, news or not.
you seem pretty set on this. Is there a reason that you dislike people taking your photo?
BTW I have seen the Moderators coming down pretty heavy on the Cruise Lines at times. I have learned that they say it the way it is.

On advice in another thread, I checked out Cunard and their terms - no such clause. I may have found my next cruise line thanks to this site.

It's one thing being in the background of someone's private holiday picture that they're going to put in a photo album on a shelf.

It's quite another for a company that is hosting you to say "We'll take pictures of you at will and use them whenever, wherever and however we please for our own profit." As I said, my recollection is that the wording is quite agressive, leaving all sorts of possibilities open. Perhaps not likely, but they have left themselves the option. Maybe you're a staunch Democrat - maybe you and your wife show up in a banner ad on Rush Limbaugh's website with the caption "We love Rush and Royal Caribbean", and you've got nothng to say about it.

Do you really think they would post a photo of someone that they had not screened on an add like you mentioned? The fallout would be great.
Again it is done all the time, don't get mad at them for letting you know they do it.
BTW does the other Cruise Line say they will not do it? Or do they just not say anything?

I was just looking at the Cunard contract.

"Similarly, beauticians, manicurists, masseurs, photographers, instructors and other service personnel shall be considered independent contractors who work directly for the passenger. Passengers use such services at their sole risk."

So it would seem Cunard is not accountable for anything the photographers do. But then the Carnival contract uses the same words, as most likely do all of their subsidiary cruise lines.

Carnival's words about the images:

....have the exclusive right to include photographic, video and other visual portrayals of Guest in any medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to Guest, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Carnivalís sole property, free from any claims by Guest or any person deriving any rights or interest from Guest...

Yes, that's right, all of the moderators and administrators of this forum are cruise line flunkies. We only say and do what they expect us to say... and we all profit handsomely for it in free cruises and vacations.... NOT!

As I see it, you have two choices, you can worry about your image being used and decide not to cruise or you can pick a cruise line that doesn't have similar terms in their contract. Just because we don't see this clause as a major offense to our personal liberties, doesn't make us cruise line schills. Personally I think you are making much more of this than you should be. But I defend your right to complain. Just don't complain loudly to the captain... oh wait.. that's another thread...
